    If you live in the UAE, you can sign a property power of attorney before a Notary Public in Dubai, Abu Dhabi, Sharjah, Ras Al Khaimah, Fujairah, Ajman, or Um Al Quwain. Irrespective of where it is signed within the UAE, a property power of attorney remains legally valid throughout the country.

    Sign Real Estate POA outside UAE to use in UAE

    If you are not living in the UAE, you can sign a property power of attorney in front of a Notary Public in your home country. After signing, you will need to obtain attestations from the relevant government departments before it can be utilized in the UAE.

    A property power of attorney is utilized when the owner of a real estate property in the UAE requires someone to oversee the management, leasing, or sale of their property. The owner has the freedom to appoint any individual in the UAE to carry out these responsibilities. It is crucial to include the specific details of the property (or properties, if applicable) within the power of attorney document.

    A power of attorney for property in the UAE usually encompasses various powers, such as the ability to:

    • manage and lease real estate property; and/or
    • sell the real estate property to any third party.

    POA for Property in Dubai

    To facilitate the sale of a property in Dubai, the owner can authorize a power of attorney. This legal document requires the owner’s signature before a Notary Public, provided that the title deed has already been issued by the Dubai Land Department in the owner’s name.

     

    If the property is subject to a mortgage, whether through Islamic or conventional finance, the Notary Public will request a No Objection Certificate (NOC) from the financing bank. Additionally, a certified copy of the title deed issued by the bank must be submitted.

     

    However, if the title deed has not yet been issued, it is not possible for the owner to sign the power of attorney before a Notary Public in Dubai. In such cases, the owner can either await the issuance of the title deed by the Dubai Land Department or sign the power of attorney in their home country and follow the process of legalization.

     

    Furthermore, it is important to note that if the attorney or agent appointed in the power of attorney for property in Dubai does not possess a UAE residence visa, the power of attorney may not be accepted for the purpose of registering the Ejari.

     

    POA for Sale of Property in Abu Dhabi and other Emirates

    In Abu Dhabi and other Emirates, the Notary Public may request the original sale and purchase agreement or title deed of the property to be presented before the owner can sign the power of attorney. If the property has a mortgage, the Notary Public may also require an NOC from the financing bank, along with a certified copy of the title deed or sale and purchase agreement issued by the bank. These measures ensure the legal validity and smooth processing of property transactions.
