During the video call, a notary public verifies the principal’s identity and confirms their consent to issue the POA. Once the e-notarization is complete, the electronic POA will be promptly sent to your email address.
Process of Notarizing Power of Attorney in UAE
Notarizing a power of attorney in Dubai and other Emirates in the UAE involves a straightforward process that can be broken down into the following steps:
1.POA Draft Preparation
To begin, a preliminary version of the power of attorney is crafted with careful consideration of the individualized needs and preferences of the person drafting the document (referred to as the principal).
2. Arabic translation
The Power of Attorney (POA) draft must be translated into Arabic by a licensed legal translator approved by the UAE Ministry of Justice, as mandated by the Notary Public in the UAE.
3. Notarization
There are two distinct methods available for notarizing a Power of Attorney (POA) in the UAE. These methods provide individuals with options to ensure the legal validity of their POA document.
Physical (In-person) Notarization
In the UAE, powers of attorney are signed and registered with a Notary Public. The principal must personally visit the nearest Notary Public in the relevant Emirate to complete the registration process, which typically takes approximately 20-30 minutes.
E-Notarization
In certain Emirates like Abu Dhabi and Dubai, the Notary Public facilitates the registration of Power of Attorneys (POAs) through video conferencing. While the e-notarization process is overseen by the courts in Dubai or Abu Dhabi, the e-notarized POA is recognized and accepted throughout the entire UAE. This streamlined approach ensures convenience and accessibility for individuals requiring notarization services.
Process of Signing/Notarizing Power of Attorney outside UAE
A power of attorney required for use in the UAE can be signed by the principal outside the country. However, to ensure its validity in the UAE, the following process must be followed after drafting. It is important to note that this process applies to complex powers of attorney involving multiple layers of shareholders. For simpler cases, we recommend considering the e-notarization process mentioned earlier.
Step 1: Signing/Notarizing with a Notary Public
To begin, the power of attorney must be signed and notarized by a Notary Public in the principal’s country of residence. This initial step is crucial for ensuring the legal validity and authenticity of the document.
2. Legalization
After the notarization, the principal must proceed to attest the document at the Ministry of Foreign Affairs in their country of residence. It is important to note that in some jurisdictions, this responsibility may be delegated to another government department. This crucial step in the process is commonly known as legalization or apostille. By completing this procedure, the document becomes officially recognized and validated for international use.
3. Attestation by the UAE Embassy
Before completing the legalization process in the country of origin, it is necessary to have the document stamped by either the UAE Embassy or Consulate. Following this step, the document is then sent to the UAE to finalize the legalization procedure.
4. Attestation by the UAE
Upon receipt in the UAE, the document must undergo the stamping process by the Ministry of Foreign Affairs. This step is necessary to ensure compliance with the local requirements.
5. Attestation by the UAE Ministry of Justice
As the final step in the legalization process, the Power of Attorney (POA) receives a stamp from the UAE Ministry of Justice as confirmation that the Arabic translation is conducted by a duly licensed translator. If the translation of the POA occurs after attestation by the UAE Ministry of Foreign Affairs, it must be carried out on the translator’s letterhead, accompanied by their stamp. The original POA should be securely attached to the translation.
