Power of Attorney for Property Conveyancing in the UAE

The deal is agreed — let a representative drive it to the new title deed.

A property conveyancing power of attorney is built for the stretch between a signed deal and a registered one: a representative signs the transfer documents, chases the developer's no-objection certificate, works through the mortgage release with the lender, submits the file to the land department and collects the closing papers. It does not negotiate the deal — the price and terms already sit in the contract — it carries the transaction administratively to the new title deed.

That stretch is longer than most sellers and buyers expect. Between contract and registration stand the developer, the lender, the registration trustee office, the land department and the utility providers, and each of them acts only for whoever holds a written mandate. For parties completing from abroad, one well-scoped document for that chain removes the recurring question of who signs the next form.

Where it is used

Developers, lenders, registration trustee offices, land departments and utility providers

Typical situation

The deal is agreed, one party is abroad, and the paperwork needs a driving hand to registration

Language

Executed in Arabic; a bilingual draft is prepared for your review before signing

Term

Until the transfer registers, or the term written into the mandate

Who uses this POA

  • Overseas sellers whose buyer is ready and whose unit needs NOC and mortgage release work
  • Overseas buyers completing a purchase and collecting the new title deed without a trip
  • Sellers of mortgaged units who cannot attend the lender's and trustee's sessions
  • Buyers taking handover of a completed unit from a developer
  • Family members managing a property transaction for a relative abroad

What the attorney can do

  • Sign the transfer documents at the registration trustee office within the scope written into the mandate
  • Obtain the developer's no-objection certificate, confirming the unit's dues are settled
  • Follow the mortgage release with the lender — discharge letters and the removal of the registered interest
  • Submit the transfer file to the land department and answer procedural questions
  • Follow up registration with utility providers and receive the account papers
  • Collect the new title deed or the closing documents once issued

Limits and practical notes

Check these before drafting — they decide whether an authority accepts your document.

  • The mandate does not set the deal: price, payment terms and any negotiation stay with the parties, not the representative
  • Money handling is a separate power — receiving the price or paying it should be written in deliberately and tied to named accounts
  • The NOC only issues when the unit's dues are settled, so outstanding service charges stall the file regardless of the mandate
  • A mortgage release follows the lender's own procedure and timing — the POA authorizes the follow-up, it does not shorten the bank's process
  • The title must stand correctly with the principal — the mandate carries the paperwork, it cannot cure a defect in the ownership itself
  • Steps differ by emirate and by office — confirm the current sequence with the trustee office and the land department handling your file

Documents to prepare

The principal (individual)

  • Passport copy of the principal
  • Emirates ID and visa page, if the principal is a UAE resident
  • Passport details of the appointed attorney
  • Transaction papers — the sale agreement or MOU reference, title deed details and the developer's and lender's names

The mortgage release step

On a mortgaged unit, the single slowest stretch of conveyancing is usually the release: the lender must confirm settlement or consent, issue its discharge letters, and the registered interest comes off the title before the transfer can register. The representative's role is to move the paperwork between the bank, the trustee office and the land department so the file does not sit waiting.

Because the release runs on the lender's internal procedure, the honest plan is a time allowance rather than an assumption. Sellers should tell the drafting stage that the unit is mortgaged and name the lender, so the mandate explicitly covers the discharge correspondence — and anyone budgeting a completion date should confirm the current practice with the bank and the office processing the transfer.

  • Lender consent or settlement confirmation opens the release
  • Discharge letters travel between the bank, the trustee office and the land department
  • The registered interest must be off the title before the transfer registers
  • Name the lender at drafting so the mandate covers the correspondence

Frequently asked questions

How is a conveyancing POA different from a sale POA?

A sale mandate authorizes the deal itself — negotiating and signing the sale of the unit. A conveyancing mandate assumes the deal is already agreed and authorizes the administrative completion: NOC, mortgage release, transfer filings, collection of the new deed. If you are selling and the whole transaction should run in your absence, the sale mandate is the starting document and the conveyancing powers can sit inside it.

Can the attorney obtain the developer NOC?

Yes — applying for and collecting the no-objection certificate is a standard power in this mandate. Note that the NOC issues only when the unit's service charges and dues are settled, so the realistic preparation is settling the account, not just appointing the representative.

Can my representative handle the mortgage discharge?

The follow-up, yes: correspondence with the lender, collecting discharge letters and delivering them to the trustee office and the land department. The release itself runs on the bank's own procedure and timeline, which the mandate does not shorten — build a time allowance into your completion plan.

Can the attorney receive or pay money?

Only where the scope says so, and it is best tied to named accounts and stated purposes. Many parties keep the money flow outside the mandate entirely and let the representative handle signatures, submissions and collections only.

How long does the conveyancing stage take?

The administrative chain can take anywhere from a few weeks to a couple of months depending on the NOC, the mortgage release and the office workload. You get a schedule with your order, and the steps differ by emirate — confirm the current practice with the office processing your transfer.
