A court representation power of attorney authorizes a person or a law firm to act in a legal matter on your behalf: register a case, attend hearings, sign procedural documents and receive judgments and certified papers. In the UAE the mandate serves not only the courts — arbitration tribunals, public prosecution files, police matters and rent dispute committees all work through the same instrument when a party cannot appear personally.

The courts and judicial bodies read litigation mandates literally: the document should identify the dispute — the court, the case where one exists, the counterparty — and list what the representative may do, from filing to settlement where that is intended. Who may actually plead differs by court and by instance: some proceedings expect a licensed advocate, others accept the appointed attorney-in-fact, so the scope has to match the forum the case will run in.

Where it is used

UAE courts and judicial bodies — courts, arbitration tribunals, public prosecution, police and rent dispute committees

Typical situation

A party to a case lives abroad or cannot attend hearings and hands the file to a representative

Language

Registered in Arabic; you approve a bilingual draft beforehand

Term

For the duration of the proceedings, or the term written into the mandate

Who uses this POA

  • Litigants living abroad with a case running before a UAE court or committee
  • Residents whose work or travel schedule does not allow attending hearings
  • Parties appointing a law firm to conduct the proceedings in their name
  • Defendants served with a claim who cannot travel to respond in person
  • Parties at the enforcement stage collecting on a judgment without being in the country

What the attorney can do

  • Register and file cases, claims and applications in the principal's name
  • Attend hearings and follow the proceedings before the named forum
  • Submit and sign memoranda, requests and procedural documents within the scope
  • Request and receive certified copies of judgments, orders and the case file
  • Conclude settlement or accept partial claims, only where this power is written in explicitly
  • Appoint lawyers for the proceedings, where the mandate includes sub-delegation

Limits and practical notes

Check these before drafting — they decide whether an authority accepts your document.

  • Whether the attorney-in-fact may plead or only a licensed advocate may differs by court and instance — confirm the practice of the forum handling your case
  • A mandate that does not identify the dispute gives the clerk nothing to verify against; name the court, the case number where it exists and the counterparty
  • Settlement is a separate power: it should be granted deliberately and, ideally, with limits — amounts, terms or a requirement to consult you
  • Criminal matters follow their own rules on representation, so describe the stage — complaint, file, enforcement — rather than the subject in general terms
  • The registered document is in Arabic; the English version is prepared for your review before signing
  • Enforcement before banks and registration authorities may need an additional mandate — a court POA does not automatically open every counter

Documents to prepare

The principal (individual)

  • Passport copy of the principal
  • Emirates ID and visa page, if the principal is a UAE resident
  • Passport details of the appointed attorney
  • Case details — the court or committee, the case number if one exists and the counterparty's name

Appointing a law firm with the same document

Court mandates are commonly issued in favour of a law firm rather than a single person, so that a team can run the file — one lawyer argues the hearing, another collects the judgment. The document can name the firm and let it act through its licensed advocates, or name both the firm and specific individuals.

The practical point is the fit between the mandate and the forum: where the instance requires an advocate, the firm's lawyer will present this POA as the basis of representation; where a non-lawyer attorney-in-fact is accepted, the same document serves a family member or manager instead. Decide the route at drafting — re-issuing a mandate mid-proceedings costs hearing dates.

  • Issue to a firm, to a named advocate, or to a non-lawyer representative — the forum decides which works
  • Sub-delegation lets the attorney appoint counsel, if you write it into the scope
  • Appeals and enforcement can sit inside one mandate or run on separate ones — decide at drafting

Frequently asked questions

Does my representative have to be a lawyer?

Not always — it depends on the forum and the stage. Some proceedings expect a licensed advocate to plead, while filing, follow-up and receiving documents can be handled by your appointed attorney-in-fact. Confirm the practice of the court or committee handling your matter before deciding whom to appoint.

Can one POA cover the case of first instance, appeal and enforcement?

It can, if each stage is written into the scope. Many litigants keep a single mandate with the stages listed, others issue a fresh document per stage. The broader the document, the more precisely it should still name the dispute — the forum accepts the mandate for the case, not for litigation in general.

Can my attorney settle the case on my behalf?

Only if you grant that power explicitly, and it is wise to attach conditions — a minimum amount, approval of terms, or a duty to consult you first. Settlement authority left open lets the representative dispose of the claim in ways you never intended, so treat this clause with care.

I am abroad and the case starts soon. What are my options?

The mandate can be notarized remotely through the electronic notary systems where the POA type is eligible, or signed before a notary in your country of residence and legalized for use in the UAE. The second route adds legalization steps, so start it as soon as the case is on the horizon.

Does the same document work for police and prosecution matters?

It can — complaints, follow-up on files and receiving papers are commonly covered — but describe the matter and stage rather than using general words, and check the current practice of the authority involved, because requirements differ between emirates and change over time.
