Power of Attorney Attestation from India for Use in the UAE

A mandate signed in India earns its force in the UAE one stamp at a time — apostille is not among them.

India is a member of the Hague Apostille Convention, but the UAE is not, so the apostille the Ministry of External Affairs issues for other destinations does not make an Indian power of attorney usable in the Emirates. For UAE purposes the document follows consular legalization: notarization and state-level attestation in India, attestation by the MEA, a stamp from the UAE Embassy in New Delhi and, after arrival, attestation by the UAE Ministry of Foreign Affairs.

The Indian route has one step many principals overlook: the state. Before the MEA looks at a notarized document, the state authority that oversees the notary — a Home Department, a Sub-Divisional Magistrate or another designated office — usually has to certify it. Only then does the central and embassy chain begin, ending with the Arabic translation made in the UAE.

Home notarization

A notary in India notarizes the power of attorney, after which the relevant state authority attests it

Legalization at home

The Ministry of External Affairs (MEA) attests the document for use abroad

UAE embassy

The UAE Embassy in New Delhi — often through its authorized service centre — affixes the attestation

The legalization chain, step by step

Each stamp confirms the previous one — a missing link sends the document back to the start.

  1. 1

Draft for the UAE and notarize

The mandate is prepared to UAE requirements — for a property sale in Dubai, the property must be identified precisely — and signed before an Indian notary. India-recognised wording does not automatically satisfy a UAE notary, so align the scope first.

  2. 2

    State-level attestation

The authority that supervises notaries in your state — Home Department, SDM or another designated office — certifies the notarization. This step is where most Indian timelines stretch, so confirm the current designated office for your state.

  3. 3

    MEA attestation

The Ministry of External Affairs attests the state-certified document, confirming the signatures in the chain up to that point. For UAE use this attestation replaces the apostille India issues for Hague countries.

  4. 4

    UAE Embassy in New Delhi

The embassy — typically through its outsourced attestation centre — places its sticker on the MEA-attested original, completing the Indian side of the process.

  5. 5

    MOFA attestation in the UAE

On arrival, the Ministry of Foreign Affairs verifies the embassy stamp. Without this mark the POA is not accepted by any UAE notary, developer or registry.

  6. 6

    Licensed legal translation

A translator licensed in the UAE renders the mandate into Arabic; if the document is destined for court proceedings, the translation is additionally attested by the Ministry of Justice.

What to watch for with documents from India

  • Documents issued in a regional language generally need certified translation into English before the state and MEA steps will accept them.
  • The state step is decided state by state — which office attests, and how quickly, depends on where the notary is registered; verify the current designated office before the document starts moving.
  • Embassy attestation in New Delhi is commonly routed through an authorized service centre rather than handled at the counter — check the current receiving centre and its submission windows.
  • NRI mandates for UAE property sales and inheritance matters are read strictly by their written scope; keep the property identification and powers specific.
  • The chain runs entirely on originals across multiple offices — build courier time between the state capital, Delhi and the UAE into your plan.

Frequently asked questions

My document already has an MEA apostille — is that enough for the UAE?

No. The UAE is not a party to the Hague Apostille Convention, so the apostille does not make an Indian POA valid there, barring rare bilateral exceptions. You need the attestation chain: state, MEA, UAE Embassy in New Delhi, MOFA.

How long does attestation from India take?

Commonly two to four weeks end to end, though the state step and the embassy centre can push it longer; embassy queues vary — confirm current processing before you commit to a closing or filing date in the UAE.

Can I avoid legalization altogether?

Often yes. UAE notaries notarize powers of attorney by video call: the mandate is drafted to UAE standards and you sign it on camera with your passport. The resulting document needs no attestation chain at all — a frequent choice for principals in India.

What if one attestation in the chain is missing?

Everything after it collapses: the MEA will not attest an uncertified state document, the embassy will not stamp one without MEA attestation, and the UAE notary will refuse a POA without the MOFA mark. The missing step must be redone before the document moves on.

Do I need to travel to the UAE to use the POA?

No. Attestation is completed on the paper original through representatives or couriers, and your attorney then acts in the UAE. Your presence is needed only for the video-notarization alternative or if you prefer to sign at a UAE notary.
